Employment Law

Employment Law has been a rapidly developing area of the law in the past 10 - 15 years. Most states, including Iowa and Nebraska, have adopted the Employment At Will Doctrine, which provides, generally, that an employer or employee may terminate the employment relationship at any time, for any reason, with certain exceptions. For example, an employer cannot legally discriminate against an employee on the basis of age, sex, race, religion or disability. An employer cannot legally retaliate against an employee for asserting a legal right, such as filing a workers' compensation claim or reporting OSHA violations.

The United States Congress has also passed legislation providing employees with certain rights under the Family Medical Leave Act (FMLA), the American with Disabilities Act (ADA) and protection from sexual harassment. Damages recoverable may include back pay, front pay, compensation for emotional distress and attorney fees.
